"Advocates for tougher immigration enforcement" are complaining that four members of the Arizona National Guard didn't take aggressive action when they encountered six to eight armed men wearing bulletproof vests near an observation point. The soldiers contacted Border Patrol agents and pulled back, investigators concluded. The Border Patrol tracked the armed men back to the border but could not locate them. However, it is reasonable to accept that the 2:1 outnumbered Guardsmen reported the situation and the Border Patrol quickly and appropriately decided to confront the intruders themselves. While this infuriates the radicals, it's absolutely the conduct all American's should expect.
The wingnut arm-chair field marshalls who are self-deluded into thinking they can criticize this situation are encouraging lawless vigilante behavior. Their own warped perceptions and preferences aside, the National Guard is supporting the Border Patrol.
There is no Declaration of War on the border (at least, we all hope not). A measured, minimal force, law-enforcement approach is all that should be allowed. But, that could include arresting those who would incite, coerc or otherwise attempt to force members of the National Guard to commit illegal acts.
I'm just waiting for the immigration laws to be enforced within our country! As a matter of fact I can't wait! I'm sick of being called a racist because I want the laws enforced. I think these people are probably the most racist group of people I've ever encountered! They don't mind one bit calling White people trash, racist and worthless. As far as that goes they don't mind calling any other race of people these names if they want the laws enforced. That includes the Mexican American people that state that they don't speak for them.
- The new 600 National Guard troops were ordered to the Texas border, by the Texas Governor (not seized without the governor's consent by the current occupant of the White House). Because they are in State status they can perform law enforcement actions. But, even Texas can't afford to run that operation for very long. The 12 border crossing teams they will form are a modest augmentation to over 6,800 Federal and State lawmen involved in Operation Wrangler.
- The four National Guard members originally discussed in this blog are volunteers from another state, assigned to serve in Federal status in Arizona and are thus prohibited by a vital Federal law, Posse Comitatus, from performing law enforcement tasks. They can certainly support, perform surveillance and coordinate with the Border Patrol. But, they cannot make arrests.

I am aware of the troops that were approached by the armed Mexican military troops. I know that they have been ordered to do nothing. I don't agree with it, but if that was there orders they did the right thing. If they had handled it differently they might be sitting in jail. We all know that!
I loved reading about Dwight D. Eisenhower 1954! He had the right idea.
The 1,700 Texas guardsmen that the current occupant of the White House (coWH) called-up are prohibited by Posse Camitatus from acting as law enforcement. They cannot arrest, and should not resort to the conduct of "ultimate violence" by shooting on sight as if the southern border was an open militarized war-zone. Their mission is to support the Border Patrol.
This blog started by discussing the case of four Federal status National Guard soldiers who honorably and effectively followed their mission and the law. It is inexcusable that they would be criticized for that, and that the Arizona National Guard Adjutant General would be called in to "explain" their conduct. Not his misison, not his orders, not his authority...none of the Arizona Legisalture's freakin' business. Can you say political side-show?
Governor Perry is wisely keeping his 600 Citizen-Soldiers assigned to Operation Wrangler in State status. That is why they can work side-by-side and even indenpendant of law enforcement to make arrests. This is precisely why America has the Militia Clause of the Constitution and Posse Comitatus.
The post-Katrina obsession of the Federal military and the neo-cons to seize control of the National Guard regardless of their Governors' consent is blatantly treasonous. Just another example of a power-hungry radical republican adminstration trampling on state's rights to compensate for their failures.
